The Declaration of Condominium must provide for unit owner’s membership and voting rights in the association. F.S. 718.104(4(j). The Bylaws must also contain many mandatory provisions regarding voting. F.S. 718.112 (2). Florida law permits electronic voting for condominium associations, provided certain requirements have been met. F.S. 718.128. Special requirements must be met before electronic voting will be lawful. F.S. 718.128 (1)-(3). Attorney Herbert Allen has experience with condominium issues. Condominium Law Overview
Condominium owners often find themselves in disputes with other owners, residents, management and the Board. At other times, insurance and liability issues arise that require careful legal analysis and carefully crafted solutions that make sense in the real world. Condominium Boards owe fiduciary duties to the owners, and must act in the best interest of the condominium.
Voting in elections must follow Florida law and the condominium documents. Before anyone takes hasty action, you must be sure that you comply with all legal requirements. The condominium should also be careful to apply common sense and common courtesy in all matters.
